The US has a long tradition of imprisoning people without charge. Set aside Guantanamo, the immigration services can detain every non US citizen without charges or access to a lawyer. They’re however obliged to give you access to the consular services of your country, but don’t inform you about this and make it difficult to exercise that right. It’s also mostly a fruitless exercise if you don’t happen to have a Western passport, and even then they are defiant towards the consular officers. China, Russia, India and a couple of Arab countries just reciprocate by jailing some US citizens on trumped charges.
